Terms and Conditions for Pixelix Affiliate Marketing Program
Introduction
This document outlines the Terms and Conditions for participation in the Pixelix Affiliate Marketing Program. The purpose of this program is to facilitate the sale of subscriptions to our design agency's services through affiliate partners. Throughout this document, 'client' refers to the client of Pixelix, 'affiliate partner' refers to the individual participating in the affiliate program, and 'we', 'us', or 'our' refers to Pixelix.
Eligibility and Enrollment
Eligibility Criteria: To become an affiliate partner, individuals must be at least 16 years of age and must reside in Israel.
Enrollment Process: Interested individuals will submit a form for our consideration. Successful candidates will then attend a 1-on-1 meeting to discuss the program details and begin the partnership.
Affiliate Obligations
Promotional Guidelines: Affiliates are expected to promote Pixelix services legally, avoiding any illegal advertising methods.
Restrictions: The use of illegal advertising tactics, including spamming and misleading advertising, is strictly prohibited.
Compliance: Affiliates must comply with all laws and regulations related to advertising in their respective jurisdictions. Affiliates are solely responsible for their advertising methods, and Pixelix assumes no liability in this regard.
Commission Structure
Commissions: 10% recurring commission will be awarded as long as the client keeps paying Pixelix. The commission amount will be a fixed commission, based on the first payment of the customer (ex. if a customer takes a plan of 300$ a month, as long as the customer will continue to work with Pixelix we will pay a 10% commission, which is 30$ commission).
Payment: Commissions are paid at the end of each month.
Non-Payment Conditions: Commissions will not be paid for refunded sales or in situations where Pixelix does not receive payment.
Intellectual Property
Usage Rights: Affiliates may use Pixelix branding and materials solely for promoting Pixelix products. These materials remain the intellectual property of Pixelix.
Restrictions: Affiliates are not permitted to alter Pixelix branding or create derivative works unless expressly authorized in writing by a Pixelix official.
Relationship of Parties
Affiliates are independent contractors and not employees of Pixelix. This agreement is non-exclusive.
Confidentiality
Affiliates must keep all information and materials shared by Pixelix confidential, disclosing them only as necessary for promoting Pixelix products.
Liability and Indemnification
Liability: Pixelix's liability in relation to the affiliate program is limited as per the terms of this agreement.
Indemnification: Affiliates are required to indemnify Pixelix against certain types of claims as specified in this agreement.
Term and Termination
Duration: Pixelix reserves the right to terminate this agreement at any point without prior notice.
Process: Affiliates wishing to exit the program will continue to receive commissions for existing client referrals, unless otherwise decided by Pixelix.
Modification of Terms
Pixelix may modify these terms at any time. Affiliates are responsible for staying informed about any changes, which may involve regularly reviewing these terms.
Dispute Resolution
Any disputes arising from this affiliate relationship will be resolved through arbitration under Israeli jurisdiction.
